Licence Summary
|
You must obtain a Premises Licence from Fife Licensing Board, if you wish to sell alcohol from premises in Fife.
A Premises Licence sets out the activities which can take place in the premises and the hours when alcohol can be sold. A premises licence does not expire and can be varied or transferred. A premises licence can be held by an individual, partnership, company, club or other body. Your premises will also require a nominated premises manager, who must hold a personal licence to authorise the sale of alcohol.
Conditions will be attached to a licence.

Eligibility Criteria
|
If applying as an individual, you must be 18 years or older.
If applying as a club, it must not be conducted to make a profit and it must have a written constitution, which contains a list of provisions as set out in the Licensing (Clubs)(Scotland)Regulations 2007. If applying as a partnership, company or other body you will have to provide details of the partners, directors or other office-bearers. |

You will also need to advertise the application by displaying a notice outside the premises. There will be a hearing before the Licensing Board to consider your application, during which the Board will decide whether there are any grounds for refusal. You will be invited to attend this hearing, and will be able to answer any queries that the Board may have. Alternatively you may choose to be represented at the hearing. Will Tacit Consent Apply?

No. It is in the public interest that the Licensing Board must process your application. If you have not heard from the Licensing Board within 4 weeks, please contact the Liquor Licensing Team.

Failed Application Redress

Appeals against the refusal of an application must be made to the Sheriff Principal of the Sheriffdom of Tayside, Central and Fife. Appeals can only be made under one of the following grounds:

Licenceholder Redress
|
Please contact your legal adviser in the first instance. The Licensing Standards Officers also have a mediating role and you may wish to contact them for more information.

Consumer Complaint
|
If anyone wishes to complain about a Premises Licenceholder, normally the first contact is made with the Licensing Standards Officer, the Liquor Licensing Team or the Police.
If that has not worked, they may seek their own professional advice. If they are in the UK, Consumer Direct will give advice or if outside the UK, the UK European Consumer Centre. |

Other Redress
|
Anyone can make objections or representations to an application for a Premises Licence.
Objections or representations may be made in writing to the Board, within 21 days of notice of the licence application being given, stating:
